لن نجانب الصواب إذ قلنا بأنّ مشكلة الطلاق هي مشكلة عاديّة تماماً. والقول بأنّها عاديّة يعني أنّها مُتكرّرة ومُنتشرة في كافة المجتمعات البشرية، شرقها وغربها. كذلك فأنّ هذه الصفة ﻻ تعني إضفاء طابع القيمة على الظاهرة، هي فقط إحالة إلى ما هو شائع ومُتكرّر.
وإلى ذلك يمكن اعتبار الطلاق بما هو كذلك صفة لصيقة بالاجتماع البشري، على التحديد اجتماع الرجل والمرأة، فهو بالمعنى التاريخي مُلازم لهذه العلاقة بوصفه أحد مآﻻتها. بهذا المعنى يمكننا الحديث عن الطلاق بمثابته أحد قوانين الطبيعة الاجتماعية.
ولثقافات الشعوب مواقف متباينة من هذا الأمر؛ ففي الوقت الذي نعتبره نحن في مجتمعاتنا العربية ظاهرة بغيضة ومذمومة باعتبارها “أبغض الحلال عند الله”، فإنّ مجتمعات أخرى تعتبرها حقاً شخصيّاً لطرفي العلاقة.
تحاول هذه السطور مقاربة مشكلة الطلاق من منظور تحليلي يذهب إلى الأسباب الكامنة فيما وراء الظاهرة التي ينبغي النظر إليها بوصفها أحد أكثر المشكلات الاجتماعية التي تضع الأسرة على محك التفكك والتلاشي، ما يعني تأثّر أفراد الأسرة بنتائجها النفسية والاجتماعيّة والأخلاقيّة المختلفة.
نتحدث هنا عن الزواج لأنه ﻻ طلاق بلا زواج، حيث أنّ الزواج والطلاق لحظتان جدليتان في العلاقة بين الرجل والمرأة. وبالتالي فمقدمات الطلاق كامنة في مقدمات الزواج. ونحن ندرك أنّه في السياق التحليلي للظاهرة أنّها نتيجة كامنة في المقدمات، وهنا فالمقدمات تسبق حتّى فعل الزواج ذي الطبيعة الاجتماعية؛ طبيعة ترى في هذا الفعل وسيلة بيولوجية ضروريّة وﻻ غنى عنها من أجل استمرار النوع الإنساني، أقرّتها جميع الشرائع السماوية والأرضية، ليس بوصفها حقاً بل بوصفها واجب اجتماعي وواجب ديني أيضاً (في الموروث الشعبي لدينا يعتبر الزواج نصف الدين، وﻻ يكتمل الدين إﻻّ به)، ويرى بعض الفلاسفة والمفكّرين بأنّ الأسرة أي الزواج كمؤسسة هي لحظة موضوعيّة للروح أو العقل.
في ألمانيا على سبيل المثال، وبالرغم من شحّ المعطيات والإحصائيات الدقيقة حول ملفات اللاجئين، أشار الإعلام أكثر من مرّة إلى انتشار ظاهرة الطلاق بين الوافدين الجدد. نساء يطلبن الطلاق بمجرّد وصولهنّ إلى ألمانيا، أو زوجات ترفضن الالتحاق بأزواجهنّ، وحتّى أزواج يرفضون القيام بإجراءات لم الشمل.
فهل تتوفّر البيئة الفرديّة المناسبة التي تجعل قرار الزواج مبنيّاً على حريّة الاختيار وموضوعيّة الإرادة ووعي الضرورة الذاتية بأبعادها النفسيّة والعاطفيّة والجسديّة؟ علماً أنّ هذه البيئة الفردية ترتبط ارتباطاً وثيقاً ببيئة أوسع هي البيئة المُجتمعيّة التي يجري فيها نظام للقيم والعادات والتقاليد المُقيّدة للبيئة الفردية المنتجة لقرار إتمام الزواج، وبالتالي هل تنبني معظم الزيجات بناءً صحيحاً يُفضي إلى استقرار ونجاح التجربة؟
نكاد نجزم أنّ معظم قرارات الزواج مرتبطة بعموم البيئة الاجتماعية، وبالتالي ثمّة رواسب اجتماعية مُتعدّدة في قرار الزواج، ويمكن الإشارة مثلاً إلى عامل القرابة أو إرادات الآخرين وتدخلاتهم، سواء قبل الزواج أو بعده، فضلاً عن قيود تفرضها موروثات وعادات وقيم اجتماعية أوسع تتعلق بتوصيات مقدسة بالزواج من داخل الجماعة الدينية أو المذهبية أو العرقية حتى، وهذا ما يقلّل حريّة اختيار الشريك.
لقد استقرّت هذه الأنماط في الوعي واللاوعي، الفردي والجمعي، بوصفها توصيات مُلزٍمة؛ ما يعني أنّ ثمّة أجواء ومناخات تقليدية هي التي تحكم في الغالب الاختيارات الفردية في مشروع الزواج وتكوين الأسرة.
السيدة “علا. ط” طبيبة أطفال قدمت من سورية مع زوجها وثلاثة أولاد إلى ألمانيا، وبعد وصولها طلبت الطلاق. تقول السيدة علا بأنّها عاشت معه خمسة عشر عاماً مشحونة ومذلّة، وبسبب وضعها الاجتماعي ووضع عائلتها لم تجد من يناصرها للطلاق سابقاً، ولخوفها من أن يأخذ منها الأولاد. تقول بأنّها تحرّرت هنا من كل هذه القيود، وقامت السلطات الألمانية بنقلها إلى مخيم خاص أنشئ خصيصاً لحالات الطلاق حيث تعيش مع أولادها.
لكن ﻻ بد من الاعتراف بأنّ كثيراً من الزيجات التي تصدر عن حرية الاختيار والإرادة انتهت إلى الفشل بالنتيجة، وليست جميع الزيجات التقليديّة تنتهي بالطلاق، فهناك الكثير من الحاﻻت المتّسمة بالاستقرار والنجاح على أقل تقدير.
تقول السيدة “مناهل. ف”: “تزوجت عن حبّ وقناعة، وأنجبت منه بنتاً، لكن بعد وصولنا إلى ألمانيا أخذ زوجي يتردّد على الملاهي الليلة ويعاشر نساء أخريات. احتملت هذا الوضع لعام كامل، وهو يعود مخموراً وينفق كل مستحقاتنا المالية خلال النصف الأوّل من الشهر، لنمضي بقيّة الشهر في الاقتراض وضيق الحيلة. لم أستطع الاستمرار فطلبت الطلاق وحصلت عليه، وتمّ نقل زوجي خارج البيت”.
في اعتقادنا أنّ المقاربة السابقة هي مربط الرهان في تفسير ظاهرة الطلاق، وإنّ حريّة الاختيار هي شرط يجب تحريره من ضواغط البيئة الاجتماعية والثقافية لكي نصل إلى اختيار مبني على الوعي والإرادة الحرة، هذا ﻻ يعني عدم وجود أسباب أخرى ذاتية أو شخصية أو مادية تقف خلف الطلاق، لكن في الغالب الأعم ﻻ ترقى إلى أهمية العوامل السابقة.
حين يوجد خلل في عملية الزواج فإنّ ذلك يقود منطقياً إلى ظهور النقيض الذي هو الطلاق، وحين تتوافر البيئة الآمنة والضمانات القانونيّة للتخلّص ممّا أصبح عبئاً خنق المرأة السورية التي عانت من ضواغط في علاقتها الزوجية، علاقة ربما كانت غير متكافئة، وربما سادها الكثير من التسلّط والاستبداد والعنف حتّى، فبالتأكيد حين تتوافر ضمانات قانونيّة وتحرّر من الشرط المادي وضواغط البيئة الاجتماعية، فإنّ ذلك سيقود إلى تحطم جدار الخوف والقلق، وسيكون الطلاق هو الخيار في هذه الحالة. وﻻيهم أن يكون بعد ذلك المكان هو سوريا أو المانيا، لأنّ قرار الطلاق لن يكون سوى إجابة منطقيّة لخللٍ أصاب المقدمات.
