قبل الإجابة على هذا السؤال، لابد من إيضاح الموقف من الخطوة الروسية الأخيرة، التي تمثلت باستغلال روسيا لمؤتمر الأستانة، وطرح مشروع دستور سوري “بنكهة روسية” على المجتمعين. والسؤال الذي يطرح نفسه هنا، هو لماذا طرحت موسكو مشروعها للدستور السوري في اجتماع الأستانة المخصّص أساساً ليس لبحث قضايا سياسية، بل لتثبيت وقف إطلاق النار؟!
مما لاشك فيه أن روسيا تريد سريعاً استثمار سيطرتها العسكرية في سورية، من خلال حمايته سياسياً، عبر فرض حلٍ سياسي يخدم مصلحتها، قبل أن ينتهي ترامب من إنجاز تشكيلته لإدارة السياسة الأمريكية الجديدة. كما ويأتي طرح موسكو لمشروع الدستور السوري لقطع الطريق أمام أي حديث عن المطالبة بمرحلة انتقالية في سورية لا تريدها موسكو، وجمع ما أمكنها من أطراف سورية معارضة ومتعارضة تحت قيادة الأسد، في حكومة واحدة مع منحها بعض الصلاحيات الشكلية، وهو ما يعني إعطاء صكّ براءة لنظام الأسد من جرائمه التي ارتكبها بحق الشعب السوري، وإعادة تكريسه ليس كما كان قائماً قبل آذار عام 2011، وبل على نحو يشبه اتفاق الطائف اللبناني الذي كرّس سلطة أمراء الحرب الأهلية اللبنانية.
فما نحتاجه في هذه المرحلة، ليس صياغة دستور جديد لسورية، على أهميته، بل إلى الاتفاق على مرحلة انتقالية تلي تثبيت وقف إطلاق النار؛ فالبلاد في حالة دمار وخراب شبه كامل بشرياً واقتصادياً، وهي تحتاج بالتأكيد إلى فترة علاجية لمساعدتها على وقف الانهيار في المجتمع، وسلوك طريق التعافي من المأساة الرهيبة التي تعيشها. هذه الفترة العلاجية تحتاج إلى مدة لا تقل عن سنتين. ولن تتعافى سورية من محنتها، إن بقي في الحكم من ساهم في تدميرها وكان بإمكانه تفادي ذلك ولم يفعل.
تفترض المرحلة الانتقالية بداية وقف العمل في الدستور الحالي، ووقف العمل بالقوانين المقيدة للحرّية والمحاكم الاستثنائية، وإصدار إعلان دستوري مؤقت، يتضمن عدداً من المبادئ الأساسية لا تتعدى أصابع اليدين، وفي مقدمها التأكيد على الالتزام بوحدة واستقلال سورية وتنوعها الثقافي والقومي والديني، والتأكيد على مدنية وديمقراطية الدولة، ومبدأ تداول السلطة سلمياً، ومبدأ سيادة القانون والمساواة فيه وأمامه لجميع السوريات والسوريين، والالتزام بمبادئ حقوق الإنسان المنصوص عليها في كافة الاتفاقيات والمواثيق الدولية ذات الصلة بحقوق الإنسان، ولاسيما المتعلقة بحقوق الطفل والمرأة وحرية الرأي والتعبير والفكر والاعتقاد، وعدم التمييز بين السوريات والسوريين لأي سبب كان، والتأكيد على استقلالية القضاء بصفته الضامن للحرّيات والحقوق، وعدم إصدار أي قانون أو تشريع ينتهك هذه المبادئ.
ويتضمن الإعلان الدستوري طريقة تشكيل الحكومة المؤقتة لإدارة البلاد خلال المرحلة الانتقالية على أن يراعي في تشكيلها التنوع السياسي والقومي والديني للسوريين. ومنحها مجتمعة كافة الصلاحيات التنفيذية وبعض الصلاحيات التشريعية، بما لا يتناقض وأحكام الإعلان الدستوري. وفور تشكيل الحكومة تعلن قبولها كافة المساعدات الخارجية غير المشروطة، وتباشر بإعادة بناء ما تهدم، وتهيئ الظروف الملائمة لعودة كافة اللاجئين بأقصى سرعة ممكنة، وتعيد تأهيل وتشغيل الإدارات والمؤسسات، وضبط الأمن، وعمل كل ما من شأنه أن يخفف المعاناة عن كافة السوريين. وتعيد هيكلة السلطة القضائية وتأمين استقلالها، كما تباشر بسحب السلاح وحصر استخدامه بقوى الجيش والأمن، على أن يُعاد تأهيلهما على أسس وطنية احترافية، وإخضاعهما لسلطة الحكومة ورقابة السلطة القضائية، وإحالة من توّرط منهم بقتل السوريين إلى المحاكم.
ويتضمن الإعلان الدستوري أيضاً النص على إنشاء هيئة للعدالة الانتقالية يأتي في مقدمة مهامها إطلاق سراح كافة المعتقلين والكشف عن المفقودين، وإنشاء صندوق لتعويض الضحايا، وإجراء مصالحة وطنية وتخليد ذكرى الضحايا، والنظر في تشكيل محاكم وطنية لمحاكمة مرتكبي جرائم الحرب أو الجرائم ضدّ الإنسانية وغيرها من الانتهاكات الخطيرة لحقوق الإنسان، وتستمر هذه الهيئة في عملها حتى إتمام عملها.
وأخيراً يجب أن ينصّ الإعلان الدستوري على تشكيل جمعية وطنية، يُنتخب نصف أعضائها من الشعب، تعمل على إصدار قانون للانتخابات، وصياغة مشروع دستور جديد للبلاد.
وحال الانتهاء من صياغة مشروع الدستور، تسلًمه للحكومة المؤقتة التي تقوم بعرضه على الاستفتاء الشعبي، وبعد أن يحوز الدستور على موافقة الشعب، تباشر الحكومة المؤقتة بتهيئة الأجواء الأمنية والسياسية والإعلامية لإجراء الانتخابات النيابية والرئاسية، بإشراف ورقابة منظمات المجتمع الأهلي المحلي والعربي والدولي وفقاً لمواد الدستور الجديد؛ حيث تنتهي مهمة الحكومة المؤقتة حكماً بعد إعلان نتائج الانتخابات النيابية والرئاسية وتشكيل الحكومة الجديدة.
السوريات والسوريون ليسوا عاجزين عن صياغة دستور، ولديهم ما يكفي من الكفاءات لصياغة دستور للبلاد، وهم ليسوا بحاجة لمن يفرض عليهم دستوراً غريباً عنهم، فما يحتاجونه اليوم من المجتمع الدولي هو الكفّ عن دعم من ساهم بتدمير البلاد، ومساعدتهم على لملمة جراحهم وإعادة بناء دولتهم بعيداً عن القتل والتدمير والاستبداد والتطرف.
