تأتي عملية التهجير والإخلاء القسري التي تعرض لها أهالي مدينة داريا، لتسلط الضوء من جديد على أحد الانتهاكات والجرائم الخطيرة التي قام النظام السوري بارتكابها منذ بداية الثورة السورية في عام 2011، حيث شهدت عدة مناطق هذه العملية سابقاً كما هو الحال في حمص والقصير، ولا تزال مناطق أخرى تتعرض وعرضة لتكون ضحية هذه الجريمة كمعضمية الشام وحي الوعر..
تعريف الإخلاء القسري:
هو طرد دائم أو مؤقت لأفراد أو أسر و\ أو مجتمعات محلية ضدّ إرادتهم من المنازل و\ أو الأراضي التي يشغلونها دون أن توفر أشكال مناسبة من الحماية القانونية أو غيرها من أشكال الحماية وتيسَر لهم سبل الحصول عليها.
وقد عرفت لجنة القانون الدولي في الأمم المتحدة جريمة الإبعاد في سياق تعريفها للجرائم ضدّ الإنسانية في مسودة الجرائم المخلّة بسلم البشرية وأمنها لعام 1954 بأنه:
“يعني إبعاد السكان أو النقل القسري للسكان أو الأشخاص المعنيين قسراً من المنطقة التي يوجدون فيها بصفة مشروعة، بالطرد أو بأي فعل قسري آخر دون مبررات قانونية يسمح بها القانون الدولي”.
وهذا ما أكدته المادة السابعة الفقرة 2/ د من النظام الأساسي للمحكمة الجنائية الدولية عندما نصّت على:
“1ـ أن يُرحّـل مرتكب الجريمة، أو أن ينقل قسراً شخص أو أكثر إلى دولة أخرى، أو مكان آخر بالطرد، أو بأي فعل قسري آخر لأسباب لا يقرّها القانون الدولي.
2ـ أن يكون الشخص أو الأشخاص المعنيين موجودين بصفة مشروعة في المنطقة التي أبعدوا منها على هذا النحو.
3ـ أن يكون مرتكب الجريمة ملماً بالظروف الواقعية التي تقررت على أساسها مشروعية هذا الوجود.
4ـ أن يرتكب هذا السلوك كجزء من هجوم واسع النطاق أو منهجي موجه ضد مجموعة من السكان المدنيين وأن يكون الجاني ينوي هذا السلوك وهذا الهجوم الواسع النطاق”.
كما نصت المادة 8 من النظام الأساسي للمحكمة الجنائية الدولية، على أن هذه الجريمة هي جريمة حرب عندما ترتكب في حالة النزاع المسلح، ولكن في نفس الوقت أقر هذا النظام بأن هذه الجريمة تنطوي على تداخل بين جرائم الحرب والجرائم ضد الإنسانية، أي أنها من الممكن ارتكابها كجريمة ضدّ الإنسانية زمني السلم والنزاع المسلح.
أنواع عمليات الإخلاء القسري:
تجري هذه العمليات من المساكن والأراضي في المناطق الحضرية والريفية، وفي البلدان النامية والمتطورة على حد سواء، ويتراوح نطاقها بين فرد واحد أو أسرة أو مجموعة أو جماعة واحدة إلى حي بأكمله أو عمليات ترحيل واسعة النطاق تشمل عشرات آلاف السكان.
وليست جميع حالات الإخلاء محظورة بموجب القانون الدولي لحقوق الإنسان؛ كأن تكون هناك ضرورة لإبعاد الأشخاص عن الأراضي المعرضة للخطر المحدق بحياتهم، ومع ذلك ينبغي أن تتماشى عمليات الإخلاء مع القوانين الوطنية والمعايير الدولية وفق الأصول القانونية، حيث لا يؤدي صدور قرار إداري أو قضائي وحده بالضرورة إلى حالة إخلاء قانونية أو مبررة بأي شكل من الأشكال، ما لم يمتثل القرار إلى المعايير الدولية لحقوق الإنسان والالتزامات المتصلة بالدولة.
ولكن في الحالات الأخرى يشكل الإخلاء القسري انتهاكاً جسيماً لعدة حقوق من حقوق الإنسان سواء بشكل مباشر أو غير مباشر، يأتي في مقدمتها الحق في الحياة والحق في عدم الخضوع لمعاملة قاسية أو لا إنسانية أو مهينة، وحق الشخص في الأمن على شخصه، والحق في مستوى معيشي ملائم (سكن وغذاء ومرافق صحية لائقة)، كذلك حق الشخص في عدم التدخل في خصوصياته أو شؤون أسرته أو بيته، وحرية التنقل واختيار مكان الإقامة.. يضاف إلى ذلك كل من الحق في الرعاية الصحية والتعليم والعمل والملكية والحق في الانتصاف الفعّال، والحق في التصويت والمشاركة في إدارة الشؤون العامة.
ويندرج الإخلاء القسرى للسكان بهدف إخراجهم من مناطقهم، ضمن جرائم الحرب وجرائم الإبادة الجماعية والجرائم ضدّ الإنسانية وفق قاموس القانون الدولي والقانون الدولي الإنساني.
ولا تنطوي حالات الإخلاء القسري بالضرورة على استخدام القوة البدنية، فيمكن أن تتم هذه الجريمة بالمضايقات والتهديدات أو بأي نوع من أنواع الترهيب، حيث يكفي جعل بقاء شخص من الأشخاص في المنزل لا يطاق بقطع إمدادات المياه والكهرباء مثلاً، لنشهد حالة إخلاء قسري.
ولا ترتبط الحماية للأشخاص من الإخلاء القسري بحقوق الملكية، فلا يتم النظر لنوع الحيازة سواء ملكية أو إيجاراً عاماً أو خاصاً أو سكناً تعاونياً أو ترتيباً جماعياً أو استثماراً أو سكناً طارئاً أو مؤقتاً أو استيطاناً غير نظامي.
وفي سورية يتم الإخلاء القسري بالقوة المادية المباشرة وبشكل معنوي أيضاً، حيث يستخدم النظام القوة المفرطة والوحشية والتهديد باستخدامها؛ واستخدام الاعتقال والحصار، مما يجبر المدنيين والمقاتلين على ترك منازلهم وبيوتهم إلى مكان آخر لا يمتّون له بصلة سوى أنه أرض سورية في حال كان الإبعاد داخلياً، على أمل الرجوع إلى ماض وتاريخ وذكريات تم دفنها مع شهداء ومشاعر وعواطف وضحكات ودموع ولحظات ماتت مع أحبة، لم يبق منها إلا الأطلال، التي يعمل النظام على محوها واختراع واقع جديد يناسبه ويناسب حلفائه المجرمين، الذين يسعون لاستيطان وهضم حقوق السكان الأصليين لهذه الأراضي دون أي وجه حق.
ويبدو أن إعادة الحال الى ما كان عليه سيكون صعباً لا سيما في ظل سيطرة النظام على السجلات الرسمية الخاصة بالأحوال المدنية والملكيات العقارية، وفي ظل مقدرته على إصدار تشريعات وقوانين تساعده في طمس معالم هذه الجرائم
