المحامي ميشال شماس
أُحدثت محكمة قضايا الإرهاب بالقانون رقم 22 لعام 2012، بحجة مكافحة الإرهاب، لكن في واقع الأمر تم إحداثها لتكون بديلاً عن “محكمة أمن الدولة العليا” سيئة الصيت، والتي أضطر النظام إلى إلغائها في شهر نيسان عام 2011 بالتزامن مع رفع حالة الطوارئ كاستجابة جزئية وشكلية تحت ضغط الحَراك الشعبي المتزايد في سورية، ليأتي إحداثها التفافاً على مطالب الحراك الشعبي، الذي تحول إلى ثورة شعبية ضد حكم الرئيس بشار الأسد ونظامه القمعي.
وقد بدت محكمة أمن الدولة العليا الملغاة بكل سيئاتها أفضل بقليل من محكمة الإرهاب، التي كانت تسمح للمحامين بالاطلاع على ملفات موكليهم وتصوير كافة الضبوط الأمنية والأوراق المبرزة في الملف، كما كانت تسمح للمحامي بالتحدث إلى موكله، ولم تكن أجهزة الأمن تحيل إليها قضايا مثل التظاهر والاعتصام والكتابة ولاسيما في وسائل التواصل الاجتماعي ضدّ النظام، والتي خُصصت لمحاربة الجرائم الخطرة الواقعة على أمن الدولة الخارجي أو الداخلي. ولكن في واقع الأمر كانت تستهدف المعارضين السياسيين للنظام ونشطاء حقوق الإنسان بالدرجة الأولى، أما الحال في محكمة الإرهاب فبدا مختلفاً تماماً؛ حيث وسع النظام دائرة الملاحقة لتشمل حتى أبسط الجرائم، بما في ذلك التظاهر أو الاعتصام والكتابة ضدّ النظام على الفيسبوك أو حتى الاستماع لما كان يسميه النظام بالقنوات الفضائية المغرضة كالجزيرة والعربية والأورينت..إلخ، أي كما يقول المثل الشعبي “انتقلنا من تحت دلفة محكمة أمن الدولة العليا إلى مزراب محكمة الإرهاب”!
وقد منح قانون إنشاء محكمة الإرهاب القضاة العاملين فيها صلاحيات واسعة، حيث أعفاهم من التقيد بالأصول والإجراءات المنصوص عليها في القوانين العادية، وترك الأمر لمشيئة القاضي في كيفية التعامل مع الموقوف؛ فله مثلاً أن يستجوبه بدون حضور محامي، ولا يعتد بطلب الموقوف بأنه يريد محام معه في الاستجواب، كما أن القاضي لا يستجيب لطلب الموقوف أو وكيله بعرضه على الطبابة الشرعية للتأكد من تعرضه للتعذيب، وغالباً ما يتقيد القاضي بالاعترافات الواردة في الضبط الأمني، ولا يسمح القاضي بتصوير أوراق ملف القضية متذرعاً بأسباب أمنية. ويضطر المحامي للانتظار أياماً حتى يتمكن من الاطلاع على ملف القضية، هذا إذا تمكن فعلاً من الاطلاع، وغالباً ما يتذرع القاضي بالانشغال لكثرة المواقيف والقضايا لديه. وخلافاً لعلنية المحاكمة، فإن رئيس المحكمة غالباً ما يجري جلسة المحاكمة في مكتبه وليس على قوس المحكمة، وبحضور مكثف لعناصر الأمن وفي جو إرهابي تماماً.
ويعتمد قضاة المحكمة بشكل أساسي على الاعترافات المدونة في الضبوط الأمنية التي انتزعت من المعتقلين بالضرب والتعذيب والإكراه الشديد. ومع أن معظم المحالين إلى هذه المحكمة يحتجون أمامها بأنهم قد تعرضوا للتعذيب وأجبروا على التوقيع على أقوال لم يدلوا بها، فإن المحكمة تتجاهل ذلك تماماً مبررة ذلك بقولها : “إن إنكار المتهم لأقواله الأمنية ما هي إلا محاولة للتملص من الجرم والإفلات من العقاب”.
باختصار، إن محكمة الإرهاب لديها قاعدة ثابتة تقول: “إن المتهم أمامها مدان حتى تثبت براءته”. وذلك خلافاً للمبدأ الشهير والمعمول في دول العالم: “المتهم بريء حتى تثبت إدانته بحكم مبرم” المنصوص عليه أيضاً في القوانين السورية بما فيها الدستور السوري نفسه. والمحكمة أنشئت بهدف ليس مكافحة الإرهاب كما يدعي النظام، بل لملاحقة كل من يقف ضدّه، وتكثيف الضغط عليهم وإرهابهم.
إننا نتطلع بأمل لمن مازال يريد أن يسمع، أن يساعد الشعب السوري على الخروج من مأساته حتي يتمكن من إعادة بناء دولته الوطنية؛ دولة الحق والقانون، دولة المؤسسات على أساس مبدأ المواطنة بصرف النظر عن السياسة والدين واللون والعرق والجنس.
