التدخل العسكري لروسيا في سوريا يثير الكثير من التساؤلات حول مشروعيته ومدى اتفاقه مع القوانين الدولية، وتبرر الحكومة الروسية هذا التدخل بأنه بناء على طلب الحكومة السورية، وبناء على اتفاقيات موقعة بينهما، فهل يمكن الاعتماد على ذلك لمنح شرعية قانونية لهذا التدخل؟
يمكن أن نقسم هذه الاتفاقيات إلى قسمين: أولهما الموقعة بين الحكومة السورية والاتحاد السوفيتي والحكومة الروسية التي ورثته قبل اندلاع الثورة السورية عام 2011، والاتفاقيات الموقعة بعد هذا التاريخ.
فالاتفاقيات الموقعة قبل تاريخ الثورة السورية هي اتفاقيات سياسية بين ممثلي دولتين حسب القانون الدولي العام، وليس بين أشخاص بصفتهم الشخصية، وبالتالي لا يمكن التمسك بها قانوناً بمواجهة خلاف داخلي عليها، ولا يمكن استخدامها لدعم طرف داخلي بمواجهة الطرف الآخر، وإلا فقدت مشروعيتها القانونية كاتفاقية دولية، وانتقلت إلى مصاف الاتفاقيات الشخصية التي لا يحميها القانون الدولي، ولا يمكن التمسك بها في مواجهته، مما يعني أن كل الدعم العسكري والسياسي الذي قدمته روسيا الاتحادية للنظام السوري هو لا يخضع لقواعد القانون الدولي والاتفاقيات، وليس دعماً لسوريا البلد والدولة، وإنما دعم طرف ضدّ آخر، وبالتالي لديها مسؤولية جزائية عندما يستخدم هذا الدعم لارتكاب جرائم حرب أو جرائم ضد الإنسانية.
أما الاتفاقيات التي تم توقيعها بعد اندلاع الثورة في سوريا، فإنها فاقدة لأي شرعية قانونية حتماً بموجب القانون الدولي.
تنص قوانين الأمم المتحدة على أنه يتوجب على الدول أن تودع الاتفاقيات الموقعة بينها لدى الأمم المتحدة حتى يصبح ملزماً. والمعاهدة هي اتفاق دولي يتم إبرامه بين شخصين أو أكثر من أشخاص القانون الدولي، وهي تعني وجود اتفاق بين دولتين أو أكثر لتحديد الحقوق والواجبات المتبادلة، أو لحل مسألة، أو تعديل علاقة، أو وضع قواعد وأنظمة تتعهد الدول باحترامها.
من شروط المعاهدة الدولية أنه لا بد أن يكون جميع أطرافها متمتعين بالأهلية القانونية، الدولة كاملة السيادة تتمتع بالأهلية الكاملة، وتستطيع إبرام كافة أنواع المعاهدات، ولكن الأمر يختلف بالنسبة للدول ناقصة السيادة أو الدول الفاشلة، التي لا يمكن أن تبرم اتفاقيات دولية، ولا يعتد بأي اتفاقيات يمكن أن تبرمها.
كما يتوجب عدم قيام التعارض بين مضمون المعاهدة أو غايتها وبين أي من قواعد القانون الدولي العام الآمرة؛ إذ أن من شأن قيام مثل هذا التعارض أن يجعل المعاهدة تتصف بالبطلان. وفى هذا الشأن نصّت اتفاقية فيينا للمعاهدات على أنه “تقع باطلة بطلاناً مطلقاً كل معاهدة تتعارض في لحظة إبرامها مع إحدى قواعد القانون الدولي العام الآمرة” لذلك لا يمكن للمعاهدات الدولية أن تتضمن القيام بجرائم حرب أو جرائم ضدّ الإنسانية، وجرائم إبادة وتطهير عرقي واستيلاء على قواعد عسكرية.
وحيث أن سوريا هي دولة فاشلة بموجب المعايير الدولية التي تنص على أن الدولة تصبح فاشلة إذا ظهر عليها عددٌ من الأعراض، أولها أن تفقد السلطة القائمة قدرتها على السيطرة الفعلية على أراضيها، أو أن تفقد احتكارها لحقّ استخدام العنف المشروع في الأراضي التي تحكمها. وثانيها هو فقدانها لشرعية اتخاذ القرارات العامة وتنفيذها. وثالثها عجزها عن توفير الحد المعقول من الخدمات العامة. ورابعها عجزها عن التفاعل مع الدول الأخرى كعضو فاعل في الأسرة الدولية. لكل ذلك وكما يظهر أن الوجود الروسي على الأراضي السوري هو وجود غير مشروع، ولا يمكن وضعه تحت بند اتفاقيات دولية أو إعطائه بعداً شرعياً قانونياً.
إن كل ما تسوقه الحكومة الروسية من أعذار أو تبريرات لتدخلها العسكري في سوريا هي خاطئة ومخالفة للحقيقة وللقانون الدولي، وهي حقيقة وقانوناً تدخل غير مشروع، ووجود عسكري يشكل قوة احتلال مباشر في ظل دولة فاشلة، وبالتالي من حق السوريين اعتبار روسيا الاتحادية عدواً عسكرياً مباشراً محتلاً لبلدهم، والرئيس الروسي وأعضاء حكومته والعسكريين الروس هم مجرمين يتوجب محاكمتهم. وعلى الأمم المتحدة رفع الشرعية عن أي معاهدة أو اتفاق بين روسيا والشخصيات السورية المتحالفة معها، واتخاذ كل الإجراءات اللازمة لإجبار روسيا على الانسحاب من سوريا ورفع الاحتلال، ومحاكمة المجرمين الذين ارتكبوا الجرائم في سوريا والمسؤولين الذين أعطوا الأوامر بهذه الجرائم.
