عانت النساء السوريات طوال سنوات عديدة من التمييز والعنف والتهميش والإقصاء الذي طالهن طوال عقود ماضية ولا يزال حالهن يستمر سوءً خلال هذه السنوات .
حيث كرّس الدستور السوري السابق والحالي الدور التقليدي للمرأة ضمن “ منظومة الأسرة “ بمفهومها التقليدي ، فضلاً على النص على الخضوع للمرجعية الدينية يما تتضمنه من تمييز وإقصاء للمرأة وإخلال بحقوقها الأساسية ولا سيما حقها في المساواة .
والقوانين السورية مليئة بالعديد من النصوص التمييزية (في قوانين الأحوال الشخصية ، و قانون العقوبات و قانون الجنسية وسواهم من التشريعات المحلية والقرارات والتعليمات الادارية والممارسات والسياسات الحكومية ..) حيث كرست قوانين الأحوال الشخصية لجميع الديانات والطوائف،ذات المرجعيات الدينية، التمييز والعنف ضد النساء وأخضعهتن لقوامة وولاية الرجال وحرمت النساء السوريات بمجمل تلك التشريعات من جميع حقوقهن وفيها تمييز واضح في قضايا الزواج والطلاق وتعدد الزوجات والطاعة والولاية والوصاية وحضانة الأطفال والنفقة والسفر والتنقل والعمل والميراث ..
ومنع قانون الجنسية النساء من حقهن في منح الجنسية لأبنائهن، وأباح قانون العقوبات ارتكارب العنف بكافةاشكاله ضدهن (الاغتصاب والتحرش والقتل بذريعة “ الشرف “…)ومنح فاعليها أعذاراً مخففة تشجعهم على ارتكاب المزيد من جرائم القتل والعنف بحق النساء دون الخشية من أي عقاب .
هذا التمييز في القوانين السورية كان له تأثيرا عميقا على حياة النساء وشعورهن بعدم الأمان والاستقرار وعدم القدرة على تطوير الذات ورفع الكفاءة والمهنية وبالتالي شكل عائقا أمام مشاركتهن في عملية اتخاذ القرار على كافة الصعد العامة والخاصة وأدى إلى عدم خلق بيئة ملائمة في المشاركة السياسية.
كل ذلك أدى إلى ترسيخ الدور التقليدي للنساء وتعزيز الصورة النمطية بموجب العادات والأعراف المحلية التي قصرت دورهن على المنزل وأباحت ، لولي أمر المرأة، تزويجها قسرياً كما اباحت لزوجها “ تأديبها “ بموجب عادات متخلفة ( تنتقص من حقوق وكرامة المرأة ) و تم تشريعها قانوناً ،وبقيت قيم النظام الأبوي وأحكامه تتحكم في حياة النساء السوريات وحقوقهن بوصفها قيمًا دينية اجتماعية مقدسة.
فضلاً عن ذلك تتعرض النساء لمختلف أوجه العنف الخاص والعام في ظل الافتقاد لقانون يجرّم العنف الأسري .
تمت كل هذه الممارسات ، طوال عقود ، وتحت ستار “ علمانية زائفة “ واعتبارات “ حماية الأمن القومي “ ومراعاة الديانات والتي كانت تستخدم كذريعة لقمع الحقوق والحريات كافةً وحقوق النساء خاصة.
كل ذلك أثر على المشاركة السياسية للنساء وكان يتم تعيين النساء في المناصب السياسية شكلياً من خلال اختيار النساء لمراعاة اعتبارات محددة اجتماعية أو دينية أو سياسية وبغض النظر عن مدى كفاءتهن و فعالية المنصب.
خلال السنوات الخمس الماضية تحملت النساء العبء الأكبر في الحفاظ على الأسرة وتمكينها من البقاء والاستمرار وبدلاً من أن يتم العمل على “ تمكين “ النساء بادرت النساء إلى العمل فعلياً على “ تمكين “ العائلة ككل لتعزيز قدرتها على الاستمرار والحياة . وهو ما عرضهن أيضاً لأسوأ ممارسات العنف الأسري والعام وخاصة العنف الجسدي والاغتصاب و التحرش والابتزاز لقاء الحصول على الخدمات الإنسانية فضلاً عن دفع البعض إلى الخضوع لممارسات الدعارة والاستغلال الجنسي واسوأ ممارسات وصور الاتجار بالنساء .
حالياً تعقد الآمال على النساء لدفع عملية التغيير وإحلال السلام بوصفهن أصحاب المصلحة الحقيقية في صنع وبناء السلام والحفاظ عليه
خلال اعوام 2014و2015 نشطت العديد من الجمعيات والتجمعات النسوية في التحضير لوقف العنف وإحلال السلم والعملية الانتقالية من خلال العمل على التحضير لما يجب ان يتضمنه دستور ديموقراطي حساس للنوع الاجتماعي يتضمن الحقوق التي ينبغي ان تتمتع بها النساء والنص على حق الحماية من العنف وعدم انتهاك حقوقهن بذرائع الدين او العرف الاجتماعي وضوابط تضمن تمكين النساء من المشاركة السياسيةوالنص على إنشاء جهات وهيئات معنية بكفالة المساواة وتمكين النساء والعمل على إزالة كل مظاهر التمييز .كما والتحضير لدراسات تتضمن جميع القوانين التمييزية وما يجب تغييره لإلغاء كافة اشكال العنف والتمييز ضد النساء السوريات. وبشكل مواز تم تشكيل مبادرات نسوية من اجل السلام.
لكن ثمة الكثير من القيود والعوائق التي لا تزال تحد من قدرة النساء على أداء هذا الدور بسبب استمرار سياسة الإقصاء التي يتعرضن لها وخلال مرحلة التفاوض تم تهميش دور المرأة وكان التمثيل النسوي في جولات جنيف المتعاقبة تمثيلاً محدوداً ، شكلياً ، هامشياً ، غير مؤثر.
وهنا نقول خلال هذه المرحلة يتعين أن يتعزز دور النساء لصنع السلام وتحقيق التغيير المطلوب ولابد من العمل على إشراك النساء في فرق التفاوض بشكل متساو وتسيهيل مشاركتهن كمفاوضات وميسرات في عمليات السلم وادراج قضايا النوع الاجتماعي في اجندات التفاوض.
إن دور المرأة السورية في تحقيق التغيير المنشود هو عمل متكامل مع دورها الجوهري والأساسي في عملية العدالة الانتقالية وهنا لابد من إشراك النساء في وضع برامج العدالة الانتقالية المراعية للنوع الاجتماعي, حيث لايمكن الحديث عن الديموقراطية والعدالة الانتقالية ودستور ديموقراطي بدون إدماج قضايا المرأة والنوع الاجتماعي في كافة الوئاثق الأساسية لأي مشروع وطني.
